  • UglyFruits wishes to:
  • Promote consumption that is as local as possible (from the Region)
  • Form a link between local producers and local consumers
  • Discover, and help you to discover, the pleasures of locally sourced food and long-forgotten dishes
Article 1: Processing of personal data
  • 1.1. In order to make purchases at UglyFruits’s online shop, you need to create an account on the website The member chooses a username and a personal password. He/she is therefore the only person who can access his/her information, which he/she may edit at any time by logging in to his/her account.
  • 1.2. The member’s delivery address must be located in the territory of the Swiss Confederation. UglyFruits reserves the right not to accept an attempted registration on the basis of the user’s location.
  • 1.3. The member is responsible for the accuracy of the data submitted to UglyFruits, which cannot be held responsible in the event of errors or inaccuracies, including on the delivery address label.
  • 1.4. Through his/her registration with UglyFruits, the member implicitly agrees to receive information from UglyFruits, via a variety of communication channels (email, letter, SMS, telephone). The member can unsubscribe from these at any time, easily and free of charge
  • 1.5. UglyFruits only passes on personal data to third parties to the extent that said data is indispensable for the proper fulfilment of the order or the processing of the payment (e.g. transmission of data to PostFinance, to a debt collection agency in the event of failure to pay, etc.). Its members’ information is treated with confidentiality.
Article 2: Orders
  • 2.1 UglyFruits delivers at home or at the member's place of work, according to the indicated coordinates.
  • 2.2 All prices given include VAT according to prevailing rates.
    Delivery charges are included in the basket amount.
    The exact charges that apply are those indicated when ordering online.
  • 2.4 All orders can be delivered 48 hours after the purchase confirmation, depending on the delivery date selected on the account.
  • 2.5 The customer can cancel delivery until 48 hours before the date of delivery by contacting the after sales service by email (
  • For all orders placed before Sunday morning 10:00 before delivery, the customer receives an e-mail indicating the contents of the order.The order can be canceled or modified always until Sunday morning 10:00.
  • 2.6 Deliveries can be suspended at any time up to 48 hours before the date of the next delivery, directly to the customer s account.
  • The holidays are to be announced until Sunday at 10 am The baskets canceled later are due (orders have already been placed).
  • 2.7 Subscription baskets include 3, 6, 12 or 24 deliveries depending on the selected offer and are pre-paid accordingly No cancellation of subscription is possible.
  • 2.8. If a product is not available at the time of delivery, UglyFruits will make its best efforts to replace it with a similar item. If this is not possible, the customer will not be charged for the item, nor will the item be sent automatically at a later time.
  • In the event of a discrepancy in the order (difference in quantity, product or quality between the invoice and the delivery), the member is asked kindly to notify UglyFruits
  • Items ordered by mistake are not taken back by UglyFruits, nor can the customer be reimbursed for them.
Article 3: Payments
  • 3.1 The concept of UglyFruits is based on a payment prior to delivery of the baskets on pain of not being delivered.
  • The member is thus obliged to pay his orders before delivery.
  • 3.2 The payment can be made either directly by credit card on the subscription confirmation page, or directly on the customer's account under the page 'My current balance' by bank transfer, credit card, twint or postfinance In this case, the customer must inform us by telephone or email of the choice of his subscription so that our customer service triggers deliveries.
Article 4: Deliveries
  • 4.1 UglyFruits works with a specific delivery service of the Post Office that usually delivers in the morning.
    The postman is instructed to leave the box behind the customer's door in case of absence.
    For any clarification and information about delivery, the customer can track the package on the website of the Post Office (and provide details for the deposit by creating an online account).
    The follow-ups are not automated.The customer can ask us the tracking number the day of delivery.
  • 4.2 Deliveries are made from Tuesday to Friday (choice of day upon registration)
  • 4.3 It may happen that the delivery is scheduled for a holiday, in which case UglyFruits reserves the right to change or not the day of delivery.This change will be communicated by email.
  • 4.5 OplaBio SA undertakes to deliver the items invoiced and to ensure that goods are kept adequately refrigerated up until delivery of the order to the member’s address, or to the distribution point that he/she has chosen. From that point onwards, responsibility for the merchandise delivered shall rest with the member alone, irrespective of whether or not he/she is present, or absent, at the time of delivery.
Article 5: Right of cancellation
  • The consumer has a period of 7 working days in which to return non-perishable foodstuffs at his/her own expense, if the products are not suitable for him/her. This period starts to run on the day on which the order is delivered to the consumer. Products will only be accepted for return if they are returned in their entirety, in their complete and intact original packaging, and in perfect condition for resale. No refunds or exchanges will be made for any perishable products which have been damaged, or whose original packaging is no longer in good condition. This right of cancellation shall be exercised without penalty, except for the return fees. If the right of cancellation is exercised, the consumer may choose to request either to receive a refund of the monies paid, or to have the product exchanged. If an item is exchanged, the cost of delivering the new item will be paid by the consumer.
Article 6: Legal notices
  • 6.1. UglyFruits cannot guarantee that the information made available on this site is completely accurate, specific or exhaustive; the photographs shown are not legally binding.
  • 6.2. In the event of a disagreement or dispute, the member undertakes to participate in mediation before initiating any legal proceedings.
  • 6.3. The place of jurisdiction of OplaBio SA is in Neuchâtel and, subject to appeal to the federal court of Switzerland, only the courts of Neuchâtel are competent to rule on disputes resulting from the interpretation of and/or failure to adhere to these terms and conditions.
